JCerme Software Solutions offers an SMS/text messaging program. If you provide your mobile number and opt in, you agree to receive text messages (SMS) from us at that number, including messages sent using automated technology. Messages may include: account and support updates and responses to your inquiries (transactional), appointment scheduling and reminders, service and project alerts, and occasional promotional or marketing offers. Consent to receive marketing text messages is not a condition of purchasing any goods or services.
Message frequency varies based on your interactions with us (for example, appointment reminders or replies to your requests), up to approximately 4 messages per month for promotional programs.
Message and data rates may apply. Rates are charged by your mobile carrier and are your responsibility. Check your mobile plan for details.
You can cancel the SMS service at any time by texting STOP to the number that messaged you. After you send STOP, we will send a one-time confirmation and will stop sending you text messages. For help, reply HELP, email contact@jcerme.com, or call (800) 375-3785.
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is not guaranteed.
You must be at least 18 years old, and the account holder or authorized user of the mobile number provided, to enroll in or use our SMS program.

The following terms apply specifically to our Website Subscription Service. This service is closed to new customers. These terms remain in force for existing subscribers for the duration of their active subscription:
The Website Subscription Service is a licensing arrangement. By subscribing, you are granted a limited, non-exclusive, non-transferable license to use the website we create for you for the duration of your active subscription. This is NOT a sale or transfer of ownership.
JCerme Software Solutions retains full ownership of all website code, design, and technical assetscreated under subscription services. Your subscription payments grant you a license to use the website, not ownership. Upon subscription cancellation, the website will be deactivated.
Under subscription services, you may NOT:
Upon subscription cancellation or non-payment, the website will be immediately deactivated. You will retain ownership of content you provided (text, images, logos), but you will NOT receive access to the website code or design files.
For subscription service clients who wish to own the website outright:
Clients on subscription plans may purchase full ownership of their website at any time. The buyout price is calculated based on the website's complexity and development value, typically ranging from$2,500 to $10,000.

The following terms apply to traditional development projects with upfront or milestone payments:
For projects where a development fee is paid (not subscription-based), full ownership of the custom code and design is transferred to the client upon final payment completion. This will be explicitly stated in the project agreement.
Clients who pay development fees may optionally add ongoing maintenance and hosting services. These maintenance fees are for services only and do not affect ownership (which you already have after paying the development fee).
Custom development projects are governed by individual project agreements that specify scope, timeline, payment terms, and ownership transfer. These project-specific agreements take precedence over general terms.
To the maximum extent permitted by law:
You agree to indemnify, defend, and hold harmless JCerme Software Solutions, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Los Angeles County, California.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website. Continued use of our services after changes constitutes acceptance of the modified terms.
