2. Services Description

JCerme Software Solutions provides the following services:

  • Website Development: Custom website design, development, and deployment using modern technologies including React, Next.js, and other frameworks
  • Website Hosting & Maintenance: Ongoing hosting, SSL certificates, security updates, and technical maintenance
  • Digital Marketing: SEO optimization, social media marketing, content creation, and online advertising
  • Software Solutions: Custom software development, CRM integrations, and business automation

3. Subscription Plans & Pricing

Our website services are offered through monthly subscription plans:

  • Single Page: $99/month - One-page professional website
  • Up to 5 Pages: $149/month - Multi-page website with up to 5 pages
  • Up to 10 Pages: $199/month - Full website with up to 10 pages

All plans include hosting, SSL certificate, maintenance, and unlimited content updates. Prices are subject to change with 30 days written notice to existing subscribers.

4. Payment Terms

By subscribing to our services, you agree to the following payment terms:

  • All payments are processed securely through Stripe
  • Subscriptions are billed monthly on the anniversary of your signup date
  • You authorize us to charge your payment method for recurring subscription fees
  • Failed payments may result in service suspension until payment is received
  • All fees are non-refundable except as expressly stated in these terms

5. Cancellation & Refund Policy

You may cancel your subscription at any time:

  • Cancel by contacting us at contact@jcerme.com or calling (800) 375-3785
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial months of service
  • Upon cancellation, your website will be taken offline unless you arrange for migration
  • We offer a 14-day satisfaction guarantee for new subscribers - contact us within 14 days of signup for a full refund

6. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information for your website project
  • Respond to our communications in a timely manner
  • Provide all necessary content, images, and materials for your website
  • Ensure you have the rights to use any content you provide
  • Not use our services for any illegal or unauthorized purpose
  • Maintain the confidentiality of any account credentials provided

7. Intellectual Property

Regarding intellectual property rights:

  • Your Content: You retain all rights to content you provide (text, images, logos, etc.)
  • Our Work: Upon full payment, you receive a license to use the website design we create for you
  • Code & Technology: We retain ownership of proprietary code, frameworks, and development tools used in creating your website
  • Third-Party Assets: Some elements may be subject to third-party licenses (stock photos, fonts, plugins)

8. Website Deliverables & Timeline

Our typical website development process:

  • Initial design concepts delivered within 5-7 business days of receiving your information
  • Revisions completed within 2-3 business days of receiving feedback
  • Final website launch within 2-4 weeks of project start (depending on complexity)
  • Timelines may vary based on client responsiveness and project scope

9. Service Level & Uptime

We strive to maintain high service quality:

  • Target uptime of 99.9% for hosted websites
  • Planned maintenance will be communicated in advance when possible
  • Emergency maintenance may occur without notice to address security issues
  • We are not liable for downtime caused by third-party services, internet outages, or force majeure events

10. Limitation of Liability

To the maximum extent permitted by law, JCerme Software Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless JCerme Software Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

12. Termination

We reserve the right to terminate or suspend your account and access to our services:

  • For violation of these Terms of Service
  • For non-payment of fees
  • For conduct that we determine is harmful to other users or our business
  • For any reason with 30 days written notice

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Los Angeles County, California.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the revised terms.
